MERKT, INC. (MEI) ONE YEAR LIMITED WARRANTY
MEI warrants the products it sells (the “Products”) against defects in materials and workmanship for a period of ONE YEAR from the date of original purchase of the Products by the original purchaser (“Warranty Period”). After return of any defective Products, MEI will send the original purchaser, without charge, a new replacement for any defective Products subject to this Limited Warranty. To obtain a replacement under this Limited Warranty, please return the defective Products, postage or freight prepaid, to MEI at its address below. Such replacement is subject to verification of the defect or malfunction and proof of purchase.
Except as expressly set forth in this Limited Warranty, this Limited Warranty does not cover and MEI and its affiliates are not responsible for:
(a) failures other than those due to a defect in materials or workmanship;
(b) damage caused by alteration, accident, abuse, misuse, fire, or other external cause;
(c) defects caused by wrong assembly or use of the products, by normal wear and tear or otherwise due to the normal aging of the Products; or
(d) claims occurring after the expiration of the Warranty Period.

By purchasing or using the Products you are agreeing to be bound by the terms of this Limited Warranty. If you do not agree to the terms of this Limited Warranty, do not purchase or use any Products.
This Limited Warranty gives you specific legal rights. You may also have other rights which vary based state to state and on the laws of the applicable state, province, or country.
TO THE EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY AND THE REMEDIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES AND REMEDIES, EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEI AND ITS AFFILIATES SPECIFICALLY DISCLAIM ANY AND ALL STATUTORY OR IMPLIED WARRANTIES RELATED TO THE PRODUCTS AND YOUR PURCHASE OR USE OF THE PRODUCTS INCLUDING, WITHOUT LIMITATION:
(A) ANY AND ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE;
(B) ANY AND ALL WARRANTIES OF TITLE OR NON-INFRINGEMENT;
(C) ANY AND ALL WARRANTIES RELATED TO THE RELIABILITY OR ACCURACY; AND
(D) ANY AND ALL WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS.
If applicable law does not allow the disclaimer of any implied warranties, the duration of such warranties shall be equal to the minimum duration required by applicable law. If there is no minimum duration required by applicable law, the duration of such warranties shall be equal to the Warranty Period.
This Limited Warranty applies only to the original purchaser of the Products, and this Limited Warranty may not be transferred or assigned, in whole or in part, to any other person. This Limited Warranty only applies to the Products. If replacement Products are unavailable, MEI may offer a substitute Products acceptable to you in satisfaction of its obligations under this Limited Warranty or may offer you a refund of the purchase price paid for the original Products in satisfaction of its obligations under this Limited Warranty.
The terms of this Limited Warranty are severable. If any term of this Limited Warranty is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired. This Limited Warranty is governed by the laws of the State of Michigan without giving effect to the conflicts of laws provisions thereof. This warranty gives you specific legal rights. You may have other rights, which vary from state to state.
The provisions of the Terms and Conditions found [here] are hereby incorporated in this Limited Warranty and made an integral part hereof as if they were fully set forth herein.
