MERKT, INC. PRIVACY POLICY

Please read the following policy carefully to understand what information Merkt, Inc., (“MEI”) gathers and how MEI will use that information. This policy is subject to change. We encourage you to check the Privacy Policy each time you visit MEI’s website, www.merktinc.com (the “Site”) so that you understand our current privacy policy. By using the Site, you agree to the terms of the Privacy Policy in effect at that time.

What information does MEI collect?

MEI does not automatically collect personally identifiable information. Users must submit personally identifiable information (i.e., information that could be used to identify you individually such as your company name, your first and last name, your billing address, your shipping address, your telephone number, and your e-mail address) in connection with registration as a user of the Site. Information submitted to MEI is stored through the company creating and hosting the Site, which is currently through Typo3 by TYPO3 Association.

What are cookies and how does MEI use them?

Cookies are data files created when you visit a website and those files are stored locally (on your device). When visiting the Site, we may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to enable functions like page navigation and to allow you access to certain areas of the Site.  We also use Cookies to make your experience on the Site more personal and interactive. Information collected may include pages you viewed on the Site, number of times you accessed the Site, how long you spent on the Site, and other web traffic data. We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services.  In most instances, you can refuse cookies by turning them off in your computer’s browser.

What about Do Not Track signals the Site receives?

The Site does not recognize or respond to Do Not Track signals at this time.

What information can visitors to the Site submit to MEI?

When registering through the Site, a user may choose to submit a company name, the user’s first and last name, a billing address, a shipping address, a telephone number, an e-mail address, or other personal inforation relevant to the user's task and/or request of MEI.

Who receives the information submitted and what is done with this information?

Any information collected by or submitted to MEI is maintained by MEI and not provided to any third parties except as set forth in this Privacy Policy. MEI restricts access to the information to certain MEI employees who need to know such information in connection with their employment duties. MEI maintains security safeguards on its computer servers and uses SSL encryption.

MEI provides personally identifiable information to vendors such as Authorize.net for the purposes of processing payments for orders placed by users through the Site if this module is activated, or to logistics partners for shipping purposes.  MEI recommends that users review the privacy policies of these third-party vendors. MEI is not responsible for the information collection practices of third parties.

In connection with, during, or upon completion of a merger, acquisition, asset sale, or other business transaction that involves some, or all, of MEI's assets, data you have provided to MEI may be transferred to a successor/purchaser as part of a transaction.

How does MEI use information that you provide?

MEI uses the information provided to fulfill orders placed by users and to contact users for marketing purposes. The information submitted to MEI will only be used for the purposes described on the Site or this Privacy Policy, except when necessary in MEI’s sole discretion to satisfy any law, regulation, governmental or judicial request, or to protect MEI or its employees, attorneys, officers, directors, clients or business partners in accordance with applicable law. Otherwise, the information submitted will not be provided to any third parties except as contemplated on the Site or in this Privacy Policy. MEI may retain copies of all information submitted to MEI in either electronic or paper form, at its sole discretion.

A word of caution about security.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be absolutely secure. As a result, while we attempt to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk. Once we receive your transmission, We use reasonable administrative, technical and physical security to protect the personal information we retain and to help ensure that it is used in accordance with this Privacy Policy. However, MEI cannot guarantee that other parties will not gain access to your information.

What about children’s privacy?

The Site is not intended for children under the age of 13 and we do not intend to collect information from any person under 13 years of age on the Site. Parents should not allow children to provide any such information. If we determine that a child has provided information in violation of this policy, we will delete that information as soon as practicable. If any parent or guardian becomes aware that any child has provided information, please send us an e-mail at sales@merktinc.com so we can delete that information.

What if I have other questions or want to change or delete my information?

Please contact MEI at sales@merktinc.com with any additional questions or requests for changes or deletions to your information.  Additionally, California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our services that are California residents to request certain information regarding any disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to sales@merktinc.com.

Cross border transfers.

MEI is a company based in the United States. The Site is controlled and operated in Germany.  Information collected about you may be collected, stored and processed anywhere we engage service providers, including outside of the United States. When we transfer and process information about you, we will protect it as described in this Privacy Policy. By using the Site and our services, you consent to the transfer of information to countries outside of your country of residence which may provide for different data protection rules than in your country.

Changes to our privacy policy.

It is our policy to post any changes we make to our Privacy Policy on our Site.  If we make material changes to how we treat our users' personal information, we will notify you by email to the primary email address specified in your account or through a notice on the Site home page. The date the Privacy Policy was last revised is identified at the top of the Privacy Policy. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Site and this Privacy Policy to check for any changes. Your continued use of our Site or any products, services, or solutions following the posting of changes constitutes your acceptance of such changes.
